Alternative Dispute Resolution (ADR)

Alternative Dispute Resolution – ADR – is an increasingly popular method of resolving issues that would be time-consuming and costly to litigate in the courts. Many agreements specify some form of ADR as the means to settle disputes, including those negotiated between parties with equal bargaining power as well as standard form contracts with lots of non-negotiable “fine print.”

Jim and Bill are experienced, qualified mediators who are effective advocates for clients in all forms of ADR proceedings. When ADR is inappropriate – or their clients have obtained poor results – on occasion the partners have sought to overturn or avoid the ADR results. Further, when ADR is optional and not likely to benefit their clients, they are prepared to seek remedies through the courts instead. When ADR is appropriate, both attorneys are well-versed in preparing cases to secure the best possible results.

Jim is an acknowledged leader in the field of ADR in Massachusetts and a veteran practitioner since the late 1970s. As author of several book chapters coaching attorneys on how to achieve successful results through ADR, Jim also shares his expertise in a variety of seminars for the legal community. He has been selected by courts as a mediator, arbitrator, and as a discovery master to resolve repetitive discovery disputes between counsel. Jim has served as a neutral panel member for several ADR organizations and companies. During nearly three decades, Jim has mediated and arbitrated hundreds of cases covering a wide variety of civil matters including personal injury, property damage, insurance coverage, construction, real estate, professional liability, intra-company disputes, divorce, intellectual property, and claims of bad faith.
